GENERAL TERMS AND CONDITIONS OF BUSINESS
1.General The goods are sold between the customer and the seller "eU Alexander Geidke" in accordance with the following conditions.
2.Phases of order processing The ordering steps are as follows: - order placement by the customer - processing of the order and detailed discussion - advance payment / full payment - sorting and packaging of the goods - delivery of the goods and acknowledgment of receipt by the customer
3.Duration of contract The contract is concluded for an indefinite period.
4.Reservations The provider reserves the right to provide a service of equal quality and price
5.Cancellation Only in the event that the factory has not yet started production and no payment or deposit has been made, the order for custom-made kitchens can be canceled within 3 working days. From the 4th day after the order confirmation, cancellation is no longer possible as the kitchen is specially made in the factory for each order. In the case of prefabricated kitchens without additional modifications, i.e. not custom-made kitchens, the order can be canceled as long as payment has not yet been made. After the payment has been made, the kitchen is delivered to the customer. For individual changes and/or extensions of the prefabricated kitchens, i.e. parts additionally made for the customer, the same regulations apply as for specially made kitchens, which can only be canceled within 3 working days if the production has not yet started and no payment has been made or deposit has been made.
6. Delivery
6.1 The estimated delivery time within Germany is approximately 10 to 45 days from receipt of payment. The estimated delivery times are in working days (Monday to Friday, excluding German public holidays). Estimated delivery times are intended as a guide only, as they depend on your location and product availability. We always endeavor to deliver the goods in accordance with the delivery option requested at the time of the order. However, we cannot guarantee this and accept no liability should your order be delivered outside of a previously agreed time or date. 2 We endeavor to dispatch all orders, however please understand that some items, sizes or colors may not be available at the time of dispatch. The rest of the items will be shipped separately at no additional cost. Should your product not arrive after the estimated delivery time, please contact customer service at this email info@heidketrade.com. Neither "eU A.Geidke" nor the carrier are responsible for delays in delivery. We are not responsible for any loss caused by late delivery, regardless of the cause.
6.2 If the kitchen set is missing required parts (doors, hinges, screws, handles), the seller must deliver the missing parts to the customer free of charge. If the customer buys these parts himself at a specialized store at his own expense, the seller will not compensate for the financial costs, but can only directly supply the missing parts. Claims for costs spent in third-party transactions will not be accepted in this case.
6.3 Delivery of the kitchen is only to the curb of the house. It is the customer's responsibility to carry the packages to the house. 6.4 eU A.Geidke does not provide an assembly service. Assembly can be provided by our partner providers for an additional charge.
7.Production defects and exchange regulations The customer is obliged to check the products immediately after delivery for completeness, compliance with the delivery notes and transport defects and to report any discernible deviations and defects immediately in writing - including pictures of the product labels and pictures on which the defects are clearly visible . If the package and thus the kitchen is damaged, the customer must report this within 24 hours. If damage or defects in the kitchen only become apparent after opening the package, the customer must report this within 5 working days. The customer is requested to send the defects to ag.bestellung@gmail.com. If no complaint is made within 5 working days of receipt, the delivery is deemed to have been in accordance with the contract, unless the deviation was not recognizable despite careful examination. The customer must also check the products before assembly, otherwise the seller will not accept the complaint. In the case of advertising, it must also be clear that it is a matter of production defects and not damage caused by the customer. If there is a production defect and eU A.Geidke has confirmed this based on the pictures sent, new kitchen parts will be sent to the customer. The duration of the re-delivery depends on the stock of the required materials and therefore cannot be predicted exactly. The same delivery times apply as under 6.1. The customer is responsible for any damage caused during the installation of the kitchen.
8th.Prices and terms of payment Unless otherwise agreed, the seller's prices do not include assembly and delivery of the goods. All costs incurred in this connection shall be borne by the customer, unless otherwise agreed in advance. The price quoted includes all the necessary certificates and documents in German that are required for a sale in Germany. If the customer requires additional certificates and/or documents, the costs incurred in this connection will be charged to the customer. 3 Invoices are sent by e-mail and by post. Invoices are to be paid in full within 3 days of invoicing. The customer only has the following payment options: bank transfer, cash payment in the shop on site. Payment must be made in the currency shown on the invoice. Promotions and price reductions offered on our website are only available online. They may not correspond to those on flyers or in catalogues.
9. Fraud protection or prevention procedures In order to ensure secure transactions, we may ask you to verify your identity by confirming the accuracy of the information you have provided and by providing proof of a successful transaction. Security checks can be conducted by phone, email, or a combination of both. Should the customer object to a security check being carried out, we reserve the right to cancel the order and refund the purchase price.
10. Return of Goods
10.1 The custom-made kitchens are non-returnable, as they are individually tailored to each customer. The custom-made kitchens are individual orders with the 3D planner being individually designed, including individual sizes, shapes, dimensions, colors, etc.. If the customer finds damage to the kitchen, the damaged parts may under certain circumstances to be replaced. See regulations under point 7 (manufacturing defects and exchange regulations).
10.2 If the purchased kitchen is a prefabricated kitchen without any additional modifications, the customer has 14 days under EU law to cancel the order and in the event of a return, the customer will pay the shipping costs. Returned items must be in new, unused condition. The customer bears the costs in case of damage to the kitchen caused by the transport. If the customer has assembled more than 20% (equivalent to approximately 3 cabinets), this is automatically considered accepted and cannot be returned. In the case of minor damage (e.g. caused by transport or by the initial installation of less than 20% of the kitchen), the damage caused will be deducted from the refunded price.
10.3 Returned parts must have all original tags and stickers attached. Items must also be returned to us with the original invoice (as proof of purchase) for a full refund. The refund does not include shipping costs. You are responsible for shipping it back to our warehouse. We recommend returning items to us by courier or insured post to ensure they are protected and insured during transit. Damaged or soiled returns cannot be accepted, these can be sent back to you. A refund can also be refused. Claims for damages are not recognized if the customer has made changes to the goods such as cutting, forming, reworking or oiling. All work that is carried out on the goods represents an immediate acceptance of the goods by the customer. Furthermore, the return of such items will be refused. 4
10.4 All items that are marked as remaining stock can neither be returned nor exchanged.
11.Size and Order Confirmation While we endeavor to correctly interpret your illustration, diagram, drawing or description intended to describe the size, shape or other details of your requirement, we cannot guarantee that our interpretation is correct. We cannot be held responsible should it subsequently prove to be inaccurate. It is up to the customer to ensure that the sizes, shapes and dimensions specified in our offer meet their requirements. Before production, we create an order confirmation that forms the basis for production. It is also the customer's responsibility to ensure that the sizes, shapes and all other details of his order, as stated in the order confirmation, meet his requirements. All dimensions are given in millimeters. Insofar as these have been converted from other measurements, eg in inches, meters and/or centimetres, it is the customer's responsibility to ensure that they are correct, even if these are provided by us. We do not verify or guarantee that this information is accurate or valid. Illustrations, descriptions, weights and dimensions are only to be understood by the customer as guide values and are not binding in detail. We reserve the right to make changes in materials, dimensions and design that are reasonable and desirable without notice. Such changes do not affect the validity of the contract. The color accuracy of the products displayed on our website, in flyers, catalogs and elsewhere cannot be guaranteed due to irregularities in the image reproduction. All images and samples are to be considered as approximate only. If a kitchen order is canceled at any time, work performed up to the point of cancellation will be charged. These can exceed the payments made up to this point in time. We reserve the right to charge a lost profit fee in addition to the cost of any work already performed. If an order is completed and ready for dispatch, but the customer requests a later delivery, the remaining amount is due on the originally agreed delivery date.
12.Compensation The seller is not liable for compensation for lost profits, loss of use and other consequential damages.
13.Force Majeure To the extent permitted by law, we shall not be liable for any delay in performance of any of our obligations under these Terms and Conditions where this is caused by circumstances beyond our control. In this case, we are also entitled to a reasonable extension of the deadline for the fulfillment of these obligations.
14. Guarantees
14.1 Our kitchens come with a 5-year guarantee, with the exception of accessories. This means that if the kitchen is damaged by a production defect before 5 years have elapsed, the customer can report this and request a replacement. The customer is requested to send visible defects - including pictures of product labels and pictures where the defects are clearly visible - to ag.bestellung@gmail.com. It must be clear that the damage is due to production defects and that the customer is not responsible for the damage. An exchange can be refused if it is not clearly a matter of production defects. The remaining items have a 1-year guarantee and cannot be returned or exchanged, regardless of the reason for the return. We do not guarantee installation damage. If you move and leave your kitchen behind, the guarantee will expire as we cannot honor the new owners' guarantee claims. Please note that wood naturally moves slightly. You will find that cabinet doors and drawers move easily and small cracks can appear. It is only the wood that adapts to the temperature and humidity of your home. These small imperfections are not covered by the warranty.
14.2 The following is not covered by the guarantee: - Parts that you have modified or repaired yourself - Accidental damage or any other damage caused by you neglecting the item or not following our care instructions - Natural changes such as fading and cracks in the wood as well such as color changes in fabric and paint - rust damage - appliances, sinks and fittings from another manufacturer - if you take the goods abroad or use them in a place for which the goods are not intended - if we cannot repair the goods, we will replace it with the same or a similar model Thank you for your order eU A.Geidke
